Governor Aregbesola Issues Warning To Striking Doctors

A state High Court in Osun on Thursday, October 27, issued a seven days ultimatum to governor Rauf Aregbesola over his refusal to institute his cabinet, Vanguard reports.

The court presided by Justice Olayinka Ayoola said the governor must prepare for his defence on the matter within the next seven days.

Ayoola said the law is clear on the issue of jurisdiction and that the preliminary objections and originating summons raised allows the matter to be heard concurrently.

The judge also decried, what she described as time wasting tactics by the respondent to institute his case.

She further ordered the governor to file all necessary documents and prepare for hearing on the matter with the stipulated time.

Since assuming office in 2014, the Osun state governor is yet to constitute his cabinet.

Despite this, Aregbesola through his counsel, Fatimo Adesina prayed the court to consider the governor’s application challenging the jurisdiction of the court to hear a substantive suit filed by Kanmi Ajibola, a barrister.

Ajibola accused the governor of deliberately wasting the time of the court by bringing on the issue of jurisdiction.

He said the suit against the governor was instituted since 2015.

“My submission is that this is no longer the law.

“When the Supreme Court knew that lawyers were using all delayed tactics in the court and for safety of time, which goes to the foundation of fair hearing, the apex court said the preliminary objection, whenever raised, should be concurrently taken,” Ajibola said.

“What the Supreme Court did at that time was that at the point of judgment delivery, the court will first deal with the preliminary objection before going to the substantive issue.”

But the defence counsel in her counter argument told the court that the position of the law has since changed from the appellant’s point of argument.

She said the issue of jurisdiction must be heard first before proceeding on the substantive matter.

In his response, Ajibola told the court that the response of the defendant’s counsel was overdue, saying Aregbesola was already out of time in response to the issue on ground.

The applicant countered the defence counsel, saying the case she cited was different, adding that there was no issue of preliminary objection and time and no defence was filed as well.

He asked the court to proceed on the case, adding that the defendant was not interested in the case but was doing everything just to waste the time of the court.
